1. About this Policy

Medicure Pharma Inc. ("Medicure Pharma", "we", "us", "our") distributes ZYPITAMAG (pitavastatin) tablets in the United States. We are a subsidiary of Medicure Inc., a pharmaceutical company headquartered in Winnipeg, Manitoba, Canada.

This Policy describes how we handle personal information collected through our two ZYPITAMAG websites, which we refer to together as the "Sites":

zypitamag.com, which is intended for health care professionals; and
patient.zypitamag.com, which is intended for patients and the public.

It also covers personal information you give us by email or telephone using the contact details published on either Site.

ZYPITAMAG is sold only in the United States, and the Sites are intended for a United States audience. Nothing on them is an offer to supply the product anywhere else.

1.1 What this Policy does not cover

Our Sites link to services run by other companies, including Marley Drug, a pharmacy that is a sister company of Medicure Pharma, and WebDoctors, an independent telehealth provider. When you follow one of those links you leave our Sites, and the other company's own privacy policy governs what you give it. See Section 6.

2. Information we collect

2.1 Information you give us

Please do not include details of your own health in a message unless you need to. If you are asking about coverage or cost, we can usually help without them.

2.2 Information collected automatically

When you visit a Site, we and the providers described in Section 4 collect your IP address, browser and device type, operating system, the pages you view, the pages you arrived from and moved on to, and the dates and times of your visit. We derive an approximate location from your IP address, generally no more precise than city or region.

Because patient.zypitamag.com is about a cholesterol medication, the fact that you visit it may itself indicate an interest in cholesterol treatment. We treat browsing on that Site with that in mind, as Section 4.2 explains.

2.3 Telephone calls

Our telephone lines are operated through a third-party communications provider. Calls are recorded for quality assurance, and voicemail messages are recorded, transcribed and delivered to the member of staff they were left for. You will be told at the start of the call that it may be recorded. If you would prefer not to be recorded, you can write to us instead using the details in Section 15.

3. How we use personal information

To respond to you - answering questions about ZYPITAMAG, its cost, insurance coverage and how to obtain it.
To arrange calls with health care professionals who book one.
To send health care professionals the updates they have asked for.
To meet our regulatory obligations - recording, investigating and reporting adverse events and product complaints as required by the United States Food and Drug Administration.
To maintain the quality of our telephone service, through call recording and review.
To operate, secure and improve the Sites.
To measure and deliver our advertising, where you have consented to the technologies described in Section 4.
To comply with law, respond to lawful requests, and establish, exercise or defend legal claims.

We do not use what you write in a form or tell us on the telephone to target advertising to you.

4. Cookies and other tracking technologies

Cookies are small data files placed on your device when you visit a website. We also use pixels, tags and similar technologies, and refer to all of them as cookies here. Each Site has its own cookie banner and its own settings, so choices you make on one do not carry over to the other.

With your consent, we use analytics and advertising technologies provided by Google, Meta and Microsoft on patient.zypitamag.com. Our analytics includes a tool that records anonymised sessions - clicks, scrolling and mouse movement - so we can see where a page is confusing or broken. Because of what this Site is about, we have configured these technologies with that in mind:

They are restricted by contract to providing services to us, and may not use information from this Site for their own purposes.
They do not receive what you type into our forms.
They do not receive your name, email address or telephone number. Session recording is set to hide the contents of form fields, so what you type is not captured.

If you do not want these technologies to run, decline the targeting category in Cookie Preferences, or use Global Privacy Control as described in Section 4.5.

Some pages on both Sites contain video hosted by a third-party video platform. When that video loads, the platform receives your IP address and the address of the page you are viewing, and may set its own advertising cookies.

4.3 How our two Sites relate to each other

patient.zypitamag.com and zypitamag.com share a web address, so some cookies set on one can be read by the other. Where that happens, the analytics and advertising providers described above may recognise the same browser across both Sites.

4.4 Form protection

Our forms on patient.zypitamag.com are protected by Google reCAPTCHA, which helps us tell people from automated programs. reCAPTCHA collects information such as your IP address and how you interact with the page, and sends it to Google. Its use is subject to Google's own privacy policy and terms.

4.5 Your choices

Use the Cookie Preferences link in the footer of either Site to accept or decline each category, and to change your mind at any time. Non-essential cookies do not run until you accept them, and declining is as easy as accepting. Most browsers also let you block or delete cookies.

We recognize and honor the Global Privacy Control signal. If your browser sends it, we treat it as a request to opt out of targeted advertising and of the sale or sharing of personal information for that browser. Some browsers send a "Do Not Track" signal; there is no common standard for it and we do not respond to it.

4.6 Email

Our newsletter emails contain pixels that tell us whether a message was opened and which links were followed. Every such email contains an unsubscribe link.

5. Side effects and product complaints

If you report a side effect or a problem with ZYPITAMAG, we record what you tell us, investigate it, and report it to the United States Food and Drug Administration where we are required to. A report may include information about a patient's health, age and sex, the medicine involved and the outcome.

Drug safety regulations require us to keep these records for a set period. If you later ask us to delete your personal information, we will delete what we can, but we cannot delete adverse event records, and we will tell you when that applies.

6. Links to other companies

6.1 WebDoctors

patient.zypitamag.com links to WebDoctors, an independent online medical provider, for people who want to talk to a doctor about ZYPITAMAG. When you select Start Online Visit you leave our Site. We do not pass any information about you to WebDoctors, and any information you give WebDoctors, including during a consultation, is governed by its own privacy policy.

WebDoctors tells us how often its intake form for ZYPITAMAG is used. That information does not identify you.

6.2 Marley Drug

patient.zypitamag.com also describes how to obtain ZYPITAMAG through Marley Drug, a pharmacy that is a sister company of Medicure Pharma. If you ask us about using Marley Drug, we answer your question ourselves and may suggest that you contact Marley Drug directly. We do not pass your enquiry to Marley Drug. If you become a Marley Drug patient, Marley Drug's own privacy documents govern your information.

7. Patient stories

patient.zypitamag.com includes stories from real patients. We publish them only with each patient's written permission, and a patient may withdraw that permission at any time by contacting us, after which we will remove their story.

8. How we share personal information

8.1 Who we share it with

Within our group - with Medicure Inc., whose staff help us answer enquiries and operate the Sites.
With service providers - website development and hosting, our email platform, Microsoft for email and the booking service, our telephone provider, consent management, analytics and session recording, and form protection. These providers may use personal information only to provide services to us.
With advertising and marketing platforms - on patient.zypitamag.com only, and only where you have consented, as described in Section 4.2.
With the FDA and other authorities - where the law requires it, including adverse event reporting.
With professional advisers, and in a corporate transaction - including a sale of the ZYPITAMAG business, where personal information may be among the assets transferred.

8.2 Sale and sharing

We do not sell personal information. Some United States state laws treat certain advertising technologies as "sharing" personal information for targeted advertising even where no money changes hands. To the extent the technologies on patient.zypitamag.com are treated that way, you can opt out using Cookie Preferences or Global Privacy Control.

9. Your rights

You may ask us to give you access to the personal information we hold about you, correct it, delete it, or stop using it for a particular purpose, and you may withdraw consent you have given. We respond to every request, and we will not treat you differently for making one.

Some information we are required to keep, including adverse event records, and anything we need to comply with a legal obligation or to establish, exercise or defend a legal claim. Where that applies we will delete everything else and tell you what we have kept and why.

9.1 Washington and Nevada

If you live in Washington or Nevada, you have additional rights in health-related information collected through patient.zypitamag.com, including the right to withdraw your consent and to a list of everyone we have shared it with. Our Consumer Health Data Privacy Notice explains them.

9.2 California and other states

If you live in California or another state with a comprehensive privacy law, you may request the categories and specific pieces of personal information we hold about you, the sources, the purposes and the categories of recipients; correction; deletion; and to opt out of the sale or sharing of personal information. You do not need an account to opt out, and we will not ask you to verify your identity to do so.

9.3 How to make a request

Use the Your Privacy Choices link in the footer of either Site, email compliance@medicure.com, or call 1-800-509-0544. We will ask for information to confirm your identity for requests other than opt-outs. If we decline to act on a request, we will explain why, and you may ask us to reconsider by replying to our response.

10. Where information is held

Medicure Pharma is based in the United States, and our parent company is based in Canada. Enquiries you send us may be read and answered by staff in either country, and our website developer and some service providers are located in Canada. Where information is held outside your own country it may be accessible to the courts and authorities of that country. Wherever it is held, we handle it in accordance with this Policy.

11. How long we keep personal information

Newsletter subscriptions	While you are subscribed. Unsubscribe records are kept so we can honor your choice.
Patient stories and permissions	For as long as the story is published, and the written permission for as long as a related claim could be brought.
Cookies and device identifiers	Session cookies are deleted when you close your browser. Persistent cookies remain until they expire or you delete them.

12. Security

We maintain administrative, technical and physical safeguards designed to protect personal information against unauthorized access, use, alteration and loss, including access controls, encryption in transit, and contractual commitments from our service providers. No system is completely secure. If a security incident affects your personal information, we will notify you as required by law.

13. Children

ZYPITAMAG is not approved for people under 18, and the Sites are intended for adults. Our coverage form asks you to confirm you are 18 or older. We do not knowingly collect personal information from children, and we do not sell or share the personal information of anyone under 16. If you believe a child has given us information, contact us and we will delete it.

14. Changes to this Policy

We may update this Policy. When we do, we will change the Last Updated date and post the revised version on both Sites. If a change is material, we will give additional notice before it takes effect. We review this Policy at least once every twelve months.

IMPORTANT SAFETY INFORMATION FOR ZYPITAMAG™ (pitavastatin) tablets

INDICATIONS & USAGE

ZYPITAMAG is indicated as an adjunct to diet to reduce low-density lipoprotein cholesterol (LDL-C) in adult patients with primary hyperlipidemia.

Pediatric use information is approved for Kowa Co Ltd LIVALO (pitavastatin) tablets. However, due to Kowa Co Ltd marketing exclusivity rights, this drug product is not labeled with that information.

CONTRAINDICATIONS

ZYPITAMAG is contraindicated in the following conditions:

Concomitant use of cyclosporine.
Acute liver failure or decompensated cirrhosis.
Hypersensitivity to pitavastatin or any excipients in ZYPITAMAG. Hypersensitivity reactions including angioedema, rash, pruritus, and urticaria have been reported with pitavastatin.

WARNINGS & PRECAUTIONS

Myopathy and Rhabdomyolysis: Risk factors include age 65 years or greater, uncontrolled hypothyroidism, renal impairment, concomitant use with certain other drugs (including other lipid-lowering therapies), and higher ZYPITAMAG dosage. ZYPITAMAG is contraindicated in patients taking cyclosporine and not recommended in patients taking gemfibrozil. The following drugs when used concomitantly with ZYPITAMAG may also increase the risk of myopathy and rhabdomyolysis: lipid-modifying dosages of niacin (>1 g/day), fibrates, and colchicine. Discontinue ZYPITAMAG if markedly elevated CK levels occur or if myopathy is either diagnosed or suspected. Temporarily discontinue ZYPITAMAG in patients experiencing an acute or serious condition at high risk of developing renal failure secondary to rhabdomyolysis; e.g., sepsis; shock; severe hypovolemia; major surgery; trauma; severe metabolic, endocrine, or electrolyte disorders; or uncontrolled epilepsy. Inform patients of the risk of myopathy and rhabdomyolysis when starting or increasing the ZYPITAMAG dosage. Instruct patients to promptly report any unexplained muscle pain, tenderness or weakness particularly if accompanied by malaise or fever.
Immune-Mediated Necrotizing Myopathy (IMNM): There have been rare reports of IMNM, an autoimmune myopathy, associated with statin use, including reports of recurrence when the same or a different statin was administered. IMNM is characterized by proximal muscle weakness and elevated serum creatine kinase that persist despite discontinuation of statin treatment; positive anti-HMG CoA reductase antibody; muscle biopsy showing necrotizing myopathy; and improvement with immunosuppressive agents. Additional neuromuscular and serologic testing may be necessary. Treatment with immunosuppressive agents may be required. Discontinue ZYPITAMAG if IMNM is suspected.
Hepatic Dysfunction: Increases in serum transaminases can occur. Rare postmarketing reports of fatal and non-fatal hepatic failure have occurred. Consider liver enzyme testing before initiating therapy and as clinically indicated thereafter. If serious hepatic injury with clinical symptoms and/or hyperbilirubinemia or jaundice occurs, promptly discontinue ZYPITAMAG.
Increases in HbA1c and Fasting Serum Glucose Levels: Increases of each have been reported with statins, including ZYPITAMAG. Optimize lifestyle measures, including regular exercise, maintaining a healthy body weight, and making healthy food choices.

ADVERSE REACTIONS: The most frequent adverse reactions (rate ≥ 2%) are myalgia, constipation, diarrhea, back pain, and pain in extremity. This is not a complete list of all reported adverse events.
